MLS Documents

Since it was pretty quiet in MLS for Aviano, the Villages and Fireside yesterday I was looking at the documents associated with some short sales. You can do this too - just go to the "MLS Searches" tab, "Aviano for sale" click on the blue MLS number associated with each listing and look for the "Documents" tab in the upper right corner. There is great information in documents associated with a listing. Aside from the factual  information you can also get a feel for the tone/tenor of the information. Sound like nice folks? Cool. Sound like jerks who have a problem with communication? Bummer because you have a client who wants to buy that home. Go get 'em!

Here are some that I pulled off a listing in Fireside but this  is pretty much the norm.

"If you email or call with questions we have provided answers to below, your email/call may not be returned.
***If property is showing ACTIVE, we are still accepting offers. We might have other offers but the seller's has yet to sign them, and thus NONE have been accepted. (If we are only accepting backup offers, the home will be listed as AWC).
*** If property is showing AWC, you may submit an offer. It will be BACKUP to the other offer(s) already in place.
*** If the property is showing PENDING, we have an approved contract and escrow has been opened. Any further offers would be placed in the backup position.
*** Do NOT call to find out how many offers we currently have on a property, or how many loans the owner has on the home. Our short sale negotiating company only works on listings that we are able to get approvals on, we do not take listings with more than 2 loans or with lenders who do not cooperate on short sales.
*** Do NOT call to ask where we are in the process. If we have an accepted price by the seller's lender, that will be made clear in the MLS remarks. Otherwise, we do not know how quickly the seller's lender will make a decision on the approval.
*** Do NOT call to ask if we have submitted paperwork on behalf of the seller, to the seller's lender. We do not activate a listing until those items have been received and submitted to the bank.
*** Once your offer is received, it will be processed by our short sale company and you will receive weekly updates. Often the processing takes 2½ to 3 weeks, after which you will receive weekly updates.
o All offers must include the following:
o AAR Purchase Contract
o LSR and/or Proof of funds (if it is an all cash offer)
o HOA addendum (if applicable)
o Short Sale Addendum
o AS-IS Addendum
o Agency Disclosure
o Earnest Money Forfeiture Addendum (attached to the MLS Listing)
o Copy of earnest deposit check

And here is what the buyers will be agreeing to:

Buyer and Seller herein agree that the Buyer will deposit $1000.00 into Escrow within
8. 5 business days of both parties signing the Purchase Contract. The remaining deposit
9. balance due per the purchase contract will be deposited upon Lenders Acceptance of the
10. Purchase Contract. Both Buyer and Seller understand and agree that Buyer's $1000.00
11. earnest deposit shall be Non-Refundable for 90 days from the date of the Purchase
12. Contract. If Buyer elects to cancel the Purchase Contract within this 90 days, Buyer's
13. earnest deposit shall be released to the Seller and Purchase Contract shall be
14. cancelled immediately. If the home forecloses at any time during the transaction or
15. the Seller is in breach of contract for any reason, Buyer's earnest deposit shall be
16. refunded, in full, to the buyer immediately. In the event the Seller's Lender does not
17. deliver Written Notice of Acceptance of the Purchase contract within this 90 day
18. period, the buyer's earnest deposit is completely refundable to the Buyer immediately
19. and Buyer reserves the right to cancel the Purchase Contract without recourse by the
20. Seller under the terms of the Short Sale Addendum to the Residential Resale Real
21. Estate Purchase Contract.

23. By signing this addendum, the Buyer attests that they either do not have any other
24. active contracts on any other properties, whether waiting for Lender approval or not,
25. OR they have fully disclosed this information in writing to the Seller in the Purchase
26. Contract or an Addendum to the Purchase Contract. Buyer further agrees that should
27. they enter into an agreement to purchase another home which could, in any way, prevent
28. them from completing the purchase of this property, they will notify the Seller within
29. one calendar day, at which time the Seller may unilaterally cancel this Contract by
30. notice to Buyer at any time before delivery of the "Agreement Notice". Should the
31. Seller decide to cancel for this reason during the above referrenced 90 day period,
32. Buyer's Non-Refundable earnest money shall be released to the Seller.
